New regulation of vapes starting January 2024.
The new vaping legislation to be implemented in Australia starting from 2024 includes the following key points:
- Ban on Importation of Non-Therapeutic Vapes: Effective from 1 March 2024, the importation of all non-therapeutic vapes will be prohibited. This means any non-therapeutic vapes ordered before this date but not yet arrived in Australia will also be unlawful to import.
- Disposable Single-Use Vapes Ban: Starting 1 January 2024, disposable single-use vapes will be banned, with only very limited exceptions. Additionally, the importation of all other vapes, regardless of their nicotine content or therapeutic claims, will be banned from 1 March 2024 unless specific conditions are met.
- Closure of Personal Importation Scheme: The personal importation scheme for all vapes will end on 1 March 2024. This implies that from this date, individuals will not be able to legally purchase any vapes, including those used for smoking cessation or nicotine dependence, from overseas retailers or websites for personal use, even with a prescription.
- Ban on Manufacturing, Advertising, and Sales of Non-Therapeutic Nicotine Devices: From January 2024, the law will also prohibit the manufacturing, advertising, and sales of any non-therapeutic nicotine devices. This measure aims to limit access to vapes by teenagers and includes penalties for retailers who market to or sell to minors. Moreover, vaping restrictions similar to public smoking rules may be applied in workplaces.
